The suit, filed by Cleveland firm Dworken & Bernstein over what they call "misleading sale prices", alleges that Harbor Freight advertised merchandise at a “sale” or “compare at” price, when those items were actually not discounted.
Customers with itemized receipts can submit a claim for a minimum of 20 percent of the "you saved" amount in cash, or 30 percent of that on a gift card. Those without itemized credit or debit card statements can get up to 10 percent cash back (or 12 percent in gift cards) on total purchases of "qualifying products." Anyone without a receipt may make a written sworn statement confirming their claim, and will receive $10 gift card.
The settlement covers items bought between April 8, 2011 and December 15, 2016. Anyone interested in taking advantage of the settlement must mail or submit a claim form online by August 7.
