Benton Man Sentenced to 20 Years for Attack

A Benton man convicted of assaulting a well-known elderly man has been sentenced to 20 years in prison. 

According to the Marshall County Circuit Court Clerk, John Brumbalough was sentenced Monday on charges of first-degree assault, first-degree burglary and two counts of possession of a forged instrument, second-degree. Circuit Court Judge Dennis Foust handed down the sentences, which will run concurrently, for a total of 20 years.

The charges stem from the August 19, 2014 attack on 76-year-old Donnie Duke at his Benton home. Duke, who is affectionately known as "Bird Dog" to local residents, was an acquaintance of Brumbalough. According to police, Duke was in his home when Brumbalough was allowed inside, and attempted to rob the home. Duke was hurt while he tried to defend himself from Brumbalough's attack. He received cuts on his neck and bruises. Following the attack, community members offered an outpouring of support to Duke. 

Brumbalough will be eligible for parole in 2032.
