KY AG: Moving Parker Case Was Constitutional

The Kentucky Attorney General has responded to a motion by defense attorneys in the Marshall County shooting case, and has ruled that the transfer of Gabriel Parker's case to Circuit Court from Juvenile Court was constitutional.

Marshall County Circuit Court released the documents on Friday.

Parker was in court on Monday, and his attorney Tom Griffiths introduced a motion that the case be moved back to Juvenile Court because a full certification hearing was not conducted. Judge James Jameson didn't rule, but left the record open, knowing that Parker's lawyers had filed the motion with the Attorney General's office and a response would be coming.

In the response, the Attorney General's office said the motion was, "in effect, a challenge to the constitutionality of the automatic transfer statute," and the office agrees with the Commonwealth Attorney's response to the motion.

Griffith's argument was that the hearing in February was rushed and didn't meet full criteria for the transfer, but Assistant Commonwealth Attorney James Ford said the minimum legal requirement was met. 

Parker is charged with two count of murder and 14 counts of assault for the January 23rd shooting at Marshall County High School. He is scheduled to be back in court on August 3rd at 1:00 pm.
