BOWLING GREEN, KY - The Kentucky Court of Appeals is set to hear arguments over whether a truck driver can benefit from a U.S. Supreme Court ruling over what advice attorneys must give non-citizens about possible deportations.
 
The court will hear the case of Jose Padilla, a native of Honduras who pleaded guilty to transporting a truckload of marijuana through Hardin County in 2001. The U.S. Supreme Court ruled in 2010 that Padilla's attorney erroneously told him that deportation wasn't a concern when he pleaded guilty in 2001.
 
The high court's ruling impacted plea agreements and immigration cases around the country, but a judge in Hardin County upheld Padilla's guilty plea last year.
 
The appeals court, meeting in Bowling Green, will decide whether to apply the high court's ruling to Padilla.
