Marshall County Sheriff's Deputies were called at around 9:50 pm to the 1100 block of Union Ridge Road because of a disturbance. When they arrived, they found 39-year-old Howard "Joe" Baier, Jr. of Benton on the ground. Marshall County EMS was called, and they contacted the Coroner's office when they arrived. The Marshall County Coroner pronounced Baier dead on the scene.
An investigation by detectives revealed that Baier had been on the property of 51-year-old Jimmy Lynn Filbeck, and there had been a physical altercation. It appeared that no weapons were involved.
Baier's body was taken to Louisville for an autopsy, and was accompanied by detectives. Once the state Coroner's office report is released, detectives will present the case to a Grand Jury for a ruling.
Aurora-Ross Fire Department and Marshall County Rescue Squad assisted at the scene.
