Paul: Health Care Law 'Remains Unconstitutional'

HOPKINSVILLE, KY - U.S. Sen. Rand Paul says despite the U.S. Supreme Court upholding the constitutionality of the Affordable Care Act, he believes the law doesn't stand up to legal scrutiny.

The Kentucky Republican's comments in Hopkinsville came just a week after he issued a statement saying "Just because a couple people on the Supreme Court declare something to be 'constitutional' does not make it so. The whole thing remains unconstitutional."

The high court voted 5-4 to uphold the sweeping health care law, saying that Congress didn't have the power under the Commerce Clause to force everyone to buy health insurance, but could penalize or tax people for not doing so.

The Kentucky New Era reported that Paul said the Supreme Court's decision lifts the limits on what Congress can tax.

  So, DB sounds like he will be just fine with the Fed firing up the printing press to create fiat dollars backed by nothing to pay for this Obamacare monstrosity. Which will in turn lead to even more inflation than we already have. The government can't even handle fixing roads but we've put them in charge of our healthcare.

  Just using science, reason, and logic. Read Professor James Galbraith, he is a brilliant economist who teaches at the University of Texas. The school of economics I follow is called chartalism or Modern Monetary Theory. Google it as it is quite a legitate school of thought. I mean lets look at it. People have been screaming that we are doomed because of the deficit. I have often found that these people are con artists making quite a bit of money (Charles Goyette, Peter Schiff, Howard Ruff). In fact Doug Casey who wrote a bestseller in 1980 predicted that the US would go bankrupt in 1983. It didn't happen, but he made a lot of money in the process.

  Greece doesn't issue its own currency. People have been saying the US couldn't keep up the spending for as long as I can remember yet nothing ever happens. It's like the rapture.

  Daniel B: Sorry to be so stupid on this money thing but I am. I can understand that if we spend more than we make then we have to borrow money to make ends meet. If we issue our own money it looks to me like we could just say "start up the presses boys" and the cost of the money would be labor and materials not massive debt. It looks to me like we shouldn't have debt is we are issuing our own money.

  John C, the Feds will pay no less than 90% of the cost. The government issues its own currency and cannot run out of money. Do you rember it running out of money me neither. I have articles from the 1970s claiming it would by 1983 yet it didn't. As former VP Cheeney said, "Ronald Reagan proved deficit spending doesn't matter."

  IL is another state that is going to do it, with what money, I don't know. The feds say they will pay for it the first couple of years or so, then you're on your own. Name me a state right now that can afford Medicaid and Obama Care wants to expand it, no way that will happen. Sooner or later the free Obama money tree will run dry Have you noticed that 3 large cities in CA have filed bankrupt. One in PA has cut every city worker back to minimum wage, they will also have to go bankrupt because the unions won't stand for cut wages and benefits.

  Getting back on the story subject. I see that we have 7 states that had publicly declared that they will not create the "exchange" needed for Obamacare to work. I see that over 30 more states are not making any statements, but also not creating the exchange (this allows Democratic Governors to not comply without coming out and saying so). The reason is that Obamacare (aka Obamatax) will cost their states billions. They do not have billions to spare. Of course Beshear is one of the first to create the exchange. So because of the SC ruling, Obamacare is a non-issue. It can not work with 80% of the states staying out of it.

  Joe S, if you have been here the whole time, then how did you miss my point that our lost of freedoms started way before Bush, (actually started with FDR) and has happened by both parties ? As for your references to God, I went back and read my post again, to see what you are referring too. No Idea. God is not a human, we are human, but we are made in His image. That sure does not mean these pitiful bodies. It means our eternal Spirit. Because after all, that is what God is. I am sure that God speaks to a lot of people. I am also sure that there are many more that think they are hearing from God, and are not. Jesus warned us about that. The only way that anyone can check what you or I or anyone else says is from God, is for them to go to God directly through Christ. It is the only way to get through. I never want anyone to take what I say pertaining to God as the truth, unless they go to God themselves and make sure. I have stated that many times.   I don't feel as though I lost freedom under Bush, if so tell me what I lost. If you are talking about the Patriot Act, I would give up one or two freedoms to stay safe. But let me tell you something, Obama had control of the senate and house for two years, he could have done away with it but looks like even the most liberal wants to keep us safe to some extent. I think there's many paranoids out there or else many people that have things to hide.

  Chuck W: I assure you that I live planet earth, and likely have a wider understanding than you do. I've lived in 7 states in my adult life, and visited 38 of them -- mostly on business. You appear to believe that anyone who doesn't think you're God is somehow not a human being or a patriotic American, and that gives you license to twist facts. The fact remains that we lost lots of freedoms during the Bush presidency -- regardless of who vote for it. I can also assure you that God speaks through more people than you, and that patriotic Americans have a wide range of views.   Since I'm not paranoid and have nothing to hide, I personally like the Patriot Act as long as it saves my sorry a$$ from being blown out of the sky. Some things you don't like is for the better good of the majority. I don't like them just throwing that money around for anything and everything and this AG and his hench woman, head of homeland security won't even protect our border with Mexico. Mexico doesn't care for all those people leaving their country because they are all the poor ones anyway. We will have to support them and Mexico won't.

  Joe S, not sure what planet you hail from, but welcome to earth. We also had a bill which was later called the Patriot Act. It was started by a Senator Biden after a Federal building was blown up in Oklahoma City. Many considered the bill too out reaching so it was toned down a bit, and then signed into by our President Clinton. Then later, after America was attacked on 9/11/01, it was decided that perhaps they took too much ability out of the bill because it did not prevent that attack. So it was beefed up closer to what was first presented by Senator Biden, and the renamed the Patriot Act, and signed into law by our President Bush. Now when Bush became President, most of the country was concerned about our failing educational system. So our President Bush asked our Senate to address this issue and come up with a solution. That solution was written by two Republican Senators (Boehner and Gregg) and two Democratic Senators (Miller and Kennedy). After this bill passed the Senate with bi-partisan support, our President Bush signed it into law. As for the TSA, thing, you must be kidding???

  John C, great point. And Medicaid pays even less. Out of that tiny portion, the doctor has staff and overhead to pay also. The only doctors that are making good money are either focusing on things of vanity like cosmetic surgery which are cash based, or they are working their rear ends off seeing more patients then they should. California medicaid pays $51 for a tonsillectomy, and it takes 8 - 10 months to get that $51. How many of you would be willing to go to school for an additional 7 years to learn a skill that meant you had to work now, and wait months to get paid? As for Obama being the antichrist, he sure sees himself as a messiah anyway.   Every time I post something about the list of goals set by the American Communist Party in the 50's, I get told I am paranoid and believe in the booger man. Yet when I point out that every single one of those goals have been met or are being met now, nobody can tell me how that happens without some organized movement working toward those goals. It is time for people to wake up and decide if they want to be Americans or just citizens of a world government. We are in a fight to preserve freedom and liberty for our children and grandchildren.   John, C. the government argued that they could have the individual mandate because of the commerce clause and because of the power to tax. They may say it is not a tax but they certainly did argue that it could be considered one, as a backup argument. Roberts simply agreed, while rejecting the commerce clause argument. He did not invent it, hence he didn't "make law".

  Judge Roberts didn't rule anything, he made law. Obama from the start said it wasn't a tax, it's not called tax in the bill and Obama still says it's not a tax so how can a judge declare it's a tax. He made law and that's not his job. Since that's settled, I'm pathetic, look in the morrow.

  Step back and consider this: Perhaps there can be a lesson on the Federal constitutional law process here. Roberts was ruling on the constitutionality of the law; not whether it is bad or good. The state attorneys general who filed suit expressed an opinion that they merely doubted the constitutionality - not that they actually ruled it unconstitutional - because attorneys general are not state judges and a state supreme court has no standing on Federal law, anyway. Frankly, it is customary for any new major Federal law to be "tested" and there are tons of cases that have been filed to do just that over the history of the US.

  If one studies the Roman Empire and the US, we are headed down the same road, only quicker. Anybody that doesn't believe this, has to have their head in the sand or very dumb. Of course, for people that don't pay taxes, they don't care they think it can't affect them. Wait till their food stamps stop, their free medical with their cards.   Nearly 50% of the people in the US pay no federal income tax so the way it looks, the feds will pay for these people to get insurance, that means the ones that do pay taxes will pay for it. People hate rich people, wait till this government makes sure there's no rich people, then who is going to pay. It will be a broken country like Greece, Italy, Spain and Ireland. When people think there's going to be a free ride, all this money has to come from some where, believe it or not, it really doesn't grow on trees.

  Yes DB, I'm on Medicare, have paid into it since 1966, I now pay $100 a month. I will never get out of it what I have paid into it because like I said, Medicare doesn't pay the doctors nor the hospitals near what they charge. I don't know why you people can't get that into their heads. By the time, I pay Medicare on two people and insurance on two people, there's not a lot left. If you people that are for Obama Care think you are going to get a bargain, just wait. Those people don't know what the term Affordable really means. Lets see, Obama has gained $7 million since he's been president, so affordable to him is not affordable for me. The answer is, NO, I'm not ashamed to be on Medicare, I pay plenty for it but like you after Obama Care, I don't have a choice, I either have to be in it or else pay everything for a doctor and hospital.   The story is about the question of the constitutionality of ACA. Reality is this, 26 states have filed suit against it because they found it unconstitutional. The Federal Appeals Court ruled it unconstitutional. Four of the SC Judges ruled it unconstitutional. Four of the SC Judges ruled it constitutional. And the remaining Judge (Roberts) made it constitutional by the ruling. In other words, the SC ruling took what was already found to be unconstitutional in courts around the Nation, and made it constitutional. That was for a reason. There is one court that is higher, and holds more power, then the Supreme Court. It is the court of voters. ACA is not in our hands. It is up to us voters to decide if we want it or not. Our choices of who we elect to office, every office, will decide the future of ACA. I look at what a mess Big Government has made of the Postal Service, what happened when Big Government got involved in the housing market. I look at how much money AmTrak loses every year, and we taxpayers have to cover the loss. I watched as SS built up an increase after more choices were given to people, (401K and such), then I watch Big Government take that surplus and waste it on other things that were losing money. Only a fool would anybody with the track record of failure that Big Government has to be put in control of HealthCare. I have several family members who are veterans. I have heard over and over again how much their healthcare has declined. In Canada (were healthcare if "free"), it takes them months to get that care. Ask anybody that works in hospitals and clinics in our northern states. They constantly have Canadians coming to them to get the care they need when they need it, not when it is too late. Those who are covered with VA Healthcare benefits are now going through the same thing. My sister (she served in the Army) is now at 5 months trying to get a test for a deadly and rare disease that runs in our family. That is what it will be for all of us if ACA stands. Except we will not have any other place to go. We will be forced to wait and hope we can survive long enough. The Affordable Care Act is not only unconstitutional, it is epic failure in action because it is doing nothing more then putting the fox in charge of the hen house. Already it has caused the loss of so many jobs, and is going to cost so many more. Already it has caused our healthcare cost to increase. And it will only lead to a major decline in the quality and availability of our healthcare. So in November, when the Court of We The People convenes, we will rule this joke out of our lives by electing candidates that support our rights as individuals, that support financial responsibility, and start working on the real issues that exists in healthcare.

  You may know a nurse practitioner who makes $50.00/hr., but I have strong doubts that you know a nurse who works for a Dr. or hospital that makes that. If it is a nurse who works side by side with one of the specialists such as a cardiologist maybe, but doubtful. I guarantee you if they do the Dr. they work for is making a lot more than that. The average median salary for a nurse in Kentucky is around $55K-$75K. Now, if they are in a large city known for medical services they will make more, but their cost of living eats up the difference. You ain't a foolin' me John, so quit trying.

  Buy the way Randy, I think I know a little about nurses wages, most are in unions and they get a contract that sets their wages. The doctors don't get much from Medicare, For instance, a doctor might charge $500 but Medicare says we only consider $80 which they pay 80% and you or your insurance pays the other 20%. This is a fact, I check mine every time I see a doctor. The nurses get their pay whether it's $20 or $50 an hour. Now you might know a nurse that makes the low end but I know one that makes $50 an hour.

Obama Care will not keep the ER's empty, non of the illegals are suppose to get it but they can still use the ER. But then again, Obama might find an illegal way to put them on it. We will see come November what's going to happen so Randy be sure and get out there and vote, that is if you're not on a happy trip that day. By the way, do you know what day to vote on.   Some people refuse to accept that a large portion of their Ins. cost is already going to pay for people who do not have health care for what ever reason. The idea is to keep the uninsured out of the ER everytime a bandaid is needed. This practice started long before Obamacare, to lay it all on Obamacare is smoke.

  Look guys, you can all yap about it all you want. It is now law and come 2014 everyone, including congress, will be living under the auspices of Obamacare, (if that's what you want to call it). Romney thought it was good for his state, and he probably feels it is best for the nation, but is afraid to say it. What all it will entail and what the cost will be is yet to be seen, but IT IS THE LAW, and no matter how many times or how many different ways you complain about it it is still the law. We'll live with it and I am sure in the end it will be beneficial.

  Me and my wife had humana optimum ppo health care plan for a couple that cost 13,800 dollars per year.Because of the high cost of health care providers.Now how is Obamacare going to control the high cost of health care.When the cost of Obamacare for the american people of our aveage life time could cost as much as 35 trillion dollars.Where is all this money going to come from,the american people under the control of the federal government that will have to cut cost for your health care and you will have to pay more.You do get something for nothing and this is so hard for alot of american people to understand because they think it is the government responsibility to provide health care insurance for them at a low cost base on their income.If they are not able to pay for the cost of their insurance we all will have to pay more under the Obamacare.

Most nurses do not make a high wage, in fact they probably do not make enough. Drs. on the other hand? Well, I think everyone knows the answer to that one.

The cost of health care will never go down unless the US becomes a Cuba where people that work there never get a raise. How do people get raises, the employer has to raise the price of a product. It wouldn't surprise me if nurses don't make more than doctors. I don't know one that doesn't make a high wage, 3 are my nieces. Yes this law is constitutional but it might not be long, Roberts awoke sleeping giants and we are mad over it and will be voting. You might not like it Randy but there's more people against this law than are for it. So put that fact in your paper and smoke it.

  Actually, the Supreme Court is made up of 9 individuals, and FOUR of the FIVE said that it was unConstitutional. Go ask any 1 of those 4 if they still think it is unConstitutional, and I would bet they would stand by their decision. It's not like this was even close to a unanimous decision. Elana Kagan should have recused herself from deciding on this case since she lobbied to get Obamacare passed before being confirmed to the bench. There have been times in history that the Supreme Court got it wrong. Look it up.

  I was reading how illegal aliens are costing us $326 Million a year in lost revenue in Kentucky. That is enough to give every citizen in Kentucky (every single one) over $1 Million dollars. What would you do with $1 Million dollars? When our federal government bailed out the automakers, every family in American could have bought a brand new car for a lot less money, and produced better results. Part of every dollar ends up going to something else that has nothing to do with the intent. This is how big government and socialist policies work. Helping those who need our help, and can not afford it is one thing.I have no problem with that. Doing it through the federal government is more then stupid because ever single dollar get's skimmed off (from both sides) so that $1 worth of helping others cost us more the $1.5 in the process. This is bad law, period. It has already cost us millions of jobs, and now till cost us millions more. If you want to help those out who need our help, I am with out on that. If you want to spend twice as much of your money doing it then it would take though any other system but our federal government, you are a fool.

  The high cost of health care in america is out of control.My wife had to have surgery so she went to western baptist hospital.This was a pre-plan surgery by her doctor she was in the hospital less than 24 hrs and baptist hospital bill us for their services over 21 thousand dollars.And Obama has not done nothing about this problem in america.All he has done is created a bigger problem and Obamacare is not going to control health care cost the only thing Obamacare is going to do is control the quality of health care that you get.

  Randy this or Randy that, people think they are going to get health insurance for nothing, think again. You are going to get little but cost a lot. If the people that don't have insurance now could afford it, most would already have it. Tell you a little story, back in the 80's when my daughter went off of mine, being a type 1 diabetic, she had to go on high risk insurance, cost over $500 a month back then, think what it's going to cost now. When the government say affordable, if you believe that, you are gullible. Just look for dental insurance and see what it cost and non of Obama Care says anything about dental. If you are on welfare, you get it. So a person would be better off on welfare than buying insurance, either way, the taxpayer gets screwed. Put quite simply, if you were a deadbeat before, you will still be one. One more thing, if this plan gets repealed, are you still going to say that's constitutional. I'm not a Paul fan, certainly not his dad but to say he drew up his own surgeon license is just plain dumb.

  Let me guess Chuck, those people include you, Rush, Rand Paul, Mitch McConnell, etc. This isn't like whatever you did to make a living (aluminum can collector, scrap metal expert, professional second guesser, whatever it was). There are only a few people in this country intelligent and qualified enough to read case law, read case briefs, listen to oral argument (for whatever that's worth) and determine the constitutionality of something like the ACA.   Allow me to fill you folks in, if the Supreme Court of the United States rules that something is constitutional then it is constitutional. It sounds pretty stupid for Rand Paul or anyone else for that matter to continue to say that the healthcare law is unconstitutional when the Supreme Court has ruled that it is. It is their job to decide if something is constitutional or not and they have ruled that it is. So, guess what? It is. End of story.

  There are probably 100 Million people in the USA who are qualified to know if ACA is unconstitutional. All they have to do is read the Constitution. Rand Paul is right, this is unconstitutional and against the founding laws our Nation was built on. America is a republic, not a democracy. He swore up and down this Obama Care wasn't a tax, Roberts and the other liberals says it is. Romney says it is. But Obama still says it isn't so you tell me what you think it is, a tax or not. I say it's one of the biggest tax increases we will ever see in our life time, you have to look at the total tax, not just one little part of it.

  If enough people don't like the law, they can change it come November but it would take more than Romney, the house and senate would also have to be conservative and I don't see that happening. John Roberts made bad decisions all week the last week of June but that's the way it goes, you put a conservative judge in for life and before long, he turns liberal.   I bet that every body that is saying this is constitutional, if it had gone the other way, they would be singing a different tune. What Paul should have said that the court has said it is but that doesn't make it right. Actually, John Roberts, the turn coat, is the reason it's law. Yes, it has some good things, some, actually benefit me but there's many bad things in the law and as time goes on, you will find out how bad, just grab a Time for this week and you will see many of them. I think you are going to find out that many companies are going to pay the fine and you will have to get your own insurance or do without. But get this, the only way the IRS will get money out of you is if you have a refund coming so make sure you don't and then get this, if they don't get their money that way, then they are not going to come after you. In reality, everybody is going to get hurt.
