A father and son have been charged with stealing thousands of dollars from a Toys for Tots program in central Kentucky.

A grand jury indicted 51-year-old Rusty Gaines and his son, 30-year-old Josh Gaines on charges of stealing more than $40,000 from the state Marine Corps League and the local detachment in Franklin and Anderson Counties.

Rusty Gaines was the former treasurer of the local group.

Investigators told WKYT-TV in Lexington they noticed discrepancies in June, when, after two years, a new treasurer replaced Rusty Gaines.

The local detachment of the Marine Corps will not be allowed to participate in this year's campaign.

Both Rusty and Josh Gaines have been removed as members from the Marine Corps League.

It was not immediately clear if either man had an attorney.
