Arraignment was held Tuesday for two men accused of raping a woman at a Murray hotel earlier this year.
The Murray Sentinel reported that 57-year-old Cary Bogard of Hazel is charged with first degree rape, while 56-year-old James Underhill of Murray is accused of complicity to first degree rape by allegedly filming the incident.
Murray Police began the investigation June 16th after the victim reported she had been assaulted at the Red Roof Inn several months earlier.
The woman told investigators that she had been drinking with Bogard, Underhill and a third person when she passed out.
The victim said when she awoke, she found Bogard near her groin, She then kicked him and struck him with a bottle before leaving.
A few days later, the woman found a video on her phone that appeared to have Bogard performing relations on her while passed out.
The third person, who has not been charged, told investigators he found the woman on the bed, fully clothed and passed out.
He said he laid on the other bed and fell in and out of sleep himself. He said there was marijuana and methamphetamine in the room.
He also said he may have been drugged himself as he felt stuck to the bed and added Underhill had recorded the encounter
Bogard is being held on a $100,000 cash bond while Underhill is being held on a $50,000 cash bond. Preliminary hearings for both men will be held July 1st.
