Former Coach Facing Prison, Sex Offender Status

PADUCAH, KY - An ex-coach accused of having sex with an underage teen may serve 3 1⁄2 years in prison and have to register as a sex offender for life.

In McCracken Circuit Court Thursday, 27-year-old Sammy Montgomery pleaded guilty to charges of third-degree rape and first-degree sexual abuse.

The prosecution agreed to a 3 1⁄2 year sentence in a plea deal. Assistant Commonwealth Attorney Seth Hancock told the Paducah Sun the state will also ask for Montgomery to be considered a violent offender, which would make him ineligible for shock probation or parole. He would also have to register as a lifetime sex offender. As part of the plea bargain, Montgomery will have to complete a sex offender treatment program.

Montgomery’s sentencing is scheduled to take place at 9 am Nov. 7.

Montgomery was arrested on May 21. The third-degree rape charge is due to Montgomery being older than 21 and the teen being younger than 16. The sexual abuse charge stands because Montgomery was in a position of authority over the victim.

Montgomery was fired from his coaching position after the charges were filed.

  Bobby M 27 year old and person under 16 is not same as 19 and 16. Or am I missing your point? But I do agree about taking a leak in an alley.. Older you get and as rude as some places are about using their restrooms at times I'd like to use their counter instead of the alley.lol

  A 19 year old dating a 16 year old is not a child molester; a drunk taking a leak on the sidewalk is not a sex offender.

  Is it not against the law for a 19 year old man to have sex with a 16 child?no matter who your friends are.I have a 16 year old daughter,and I would be very upset to learn she was involved with a 19 year old man.I have a cousin who made the list for the same thing.I say good job.needs to be on it,I guess.that doesnt make the list bad,just the person on it.

  I don't think the list should be eliminated; it just shouldn't include people that are clearly no danger to anybody. If someone is listed as a violent offender there should be a history, or at least a propensity, of violence.

  I agree with you BOBBY M. List should be done away with. But if a parent finds an over aged person molesting their child the parent will be fine ONE dollar and 3 minutes in jail if they bet this person to death with a wooden ball bat. What ya think?

  jim b., The sex registry system is a mess. It needs to be corrected to protect children. As long as it is meaningless it is doing nobody any good. There are too many people on the list that are no danger to children. If you can't trust the list (and you can't) then what good is it?

  Bobby, the Sex Offender lists are ripe for abuse. In some states you can be put on one for urinating in an alley at 3 in the morning. Our former county judge executive could have been put on one when he broke his leg on the way to Frankfort. If a person is dangerous enough to be kept track of for the rest of their lives, then they do not belong in public. But these lists let the government thugs look like they are tough on crime. So they serve their purpose.

  Well you see how serious the commonwealth took it.as long as we say well hes not a bad guy,he just made a mistake.he wont do it again,or it is the first time.our children are not safe.seen people get more time for stealing,what does tell us?you can molest our children,but you better not steal thier bicycle.

  This is in no way any defense for Montgomery but part of this is an example of why sex offender lists are meaningless. He certainly qualifies for the sex offender registry but as a violent sex offender? There is no suspicion of violence. How can we trust the violent sex offender list when we know there are people on the list that are there at the whim of the prosecutor and not because they are violent. I know a man that is married with five kids that is on the sex offender list. I was surprised when I found out so I did some research to see if my daughter needed to avoid one of his kids as a friend. Turns out when he was 19 and his girlfriend was 16 her dad got mad at him and filed charges. Fine. Is this someone that really needs to be on the registry? By the way, twenty years later they have been married for 18 years and have five kids. Really? A sex offender? Bunk.
